"Jari" Application

1. Introduction and Acceptance of Terms

The "Jari" application (hereinafter referred to as the "Application" or the "Platform") welcomes its users. By downloading, registering for, or using the Application in any way, you acknowledge that you have read and understood these Terms of Use and agree to be bound by them and by the accompanying Privacy Policy. If you do not agree to any provision of these terms, please do not use the Application.

2. Nature of the Service

"Jari" is a digital platform designed to facilitate communication among neighbors within residential neighborhoods and communities in the United Arab Emirates, through features such as neighbor introductions, community announcements, service exchange, and local alerts. The Application is solely a technical intermediary and bears no responsibility for actual interactions that take place between users outside the Platform.

3. Eligibility to Use the Service

• The user must be 18 years of age or older, or use the Application under the supervision of a legal guardian in accordance with applicable regulations.
• Accurate and correct registration information must be provided (a UAE phone number or valid identification information when requested, to verify place of residence).
• The Application reserves the right to request verification of identity or residential address to ensure the authenticity of the declared "neighborhood."

4. Acceptable Use and Compliance with Local Laws

When using the Application, the user undertakes to fully comply with all laws, regulations, and legislation in force in the United Arab Emirates, at both the federal and local levels. Use of the Application for any of the following purposes is expressly and absolutely prohibited, including but not limited to:

• Any activity that violates the Federal Decree-Law on Combating Rumours and Cybercrimes (Federal Decree-Law No. 34 of 2021, as amended), including cyberbullying, extortion, impersonation, or the dissemination of false information.
• Publishing or circulating any content that offends public order or public morals, or pornographic or indecent content.
• Hate speech, or racial, sectarian, or religious discrimination, or any content that incites sedition or undermines national unity, pursuant to the Federal Decree-Law on Combating Discrimination and Hatred (Federal Decree-Law No. 34 of 2023).
• Insulting the symbols of the State, the government, the ruling family, or any official authority.
• Defamation, slander, or infringement of others' privacy, or publishing photos/information about neighbors without their consent, in violation of personal data protection law.
• Promoting unlicensed commercial, advertising, or network-marketing activities within the Platform.
• Collecting other users' data or exploiting the "neighbor introduction" feature for fraudulent purposes, stalking, or harassment.
• Any activity related to money laundering, terrorism financing, or unlawful financial transactions.
• Using the Application to promote or facilitate the sale of goods or services that are legally prohibited (such as narcotics, weapons, unlicensed alcoholic beverages, etc.).
• Infringing the intellectual property rights of others when posting any content within the Application.
• Attempting to hack the system, using automated software (bots) to collect Platform data, or reverse-engineering the Application.

The Application reserves the right to suspend or terminate the account of any user who violates these Terms immediately and without prior notice, and to report such violations to the relevant authorities where applicable, including the Telecommunications and Digital Government Regulatory Authority (TDRA) or the relevant security agencies.

5. User-Generated Content

• Each user bears full responsibility for any content they post (text, images, comments, advertisements).
• The user grants the Application a non-exclusive license to use such content for the purpose of operating the Service and displaying it to the relevant users within the same neighborhood or community.
• The Application reserves the right to remove any content that violates these Terms without the need to state reasons.

6. Accounts and Security

The user is responsible for maintaining the confidentiality of their account credentials and password, and for all activities carried out through their account. The Application's administration must be notified immediately in the event of a suspected breach or unauthorized use.

7. Subscriptions and Payments (if applicable)

Where paid features are available, the payment and refund terms announced at the time of the transaction shall apply, and all financial transactions shall be subject to UAE consumer protection regulations.

8. Intellectual Property

All rights related to the Application, including the trade name "Jari," the logo, the design, the source code, and original content, are exclusively owned by the owners of the Application and are protected under UAE copyright and neighboring rights law and any relevant international agreements.

9. Termination of Service

The Application has the right to suspend or cancel any user's account, temporarily or permanently, in the event of a breach of these Terms, or upon the request of a competent judicial or regulatory authority.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. The courts of the Emirate of Abu Dhabi (or the emirate determined by the official registered office of the operating company) shall have jurisdiction over any dispute arising from the use of the Application, unless an alternative dispute-resolution mechanism (such as arbitration through an accredited center) is agreed upon.

12. Amendment of Terms

The Application reserves the right to amend these Terms at any time, and users will be notified of material changes via the Application or their registered email address. Continued use after such amendment constitutes implicit acceptance of the updated Terms.

1. Data We Collect

• Registration data: Name, phone number, email address, date of birth (to verify eligibility).
• Geolocation data: Used to determine the neighborhood/residential complex in order to connect the user with their actual neighbors only, with the ability to control the precision of location sharing.
• Identity/residence verification data: Such as a UAE ID image or a lease/title deed, used exclusively for verification purposes and never displayed to other users.
• User-generated content: Posts, messages, photos, and comments within the Platform.
• Technical data: Device type, operating system, IP address, and usage logs, for the purposes of improving performance and security.

2. Basis and Purposes of Processing

Data is processed on a clear legal basis (consent, contract performance, or legitimate interest), for the following purposes:

• Operating the Service and connecting the user with their actual neighbors.
• Verifying identity and preventing fake accounts.
• Improving the user experience and developing new features.
• Communicating with the user (notifications, security alerts, updates).
• Complying with any legal obligation or official request from a competent government authority in the State.

3. Sharing Data with Third Parties

• Users' personal data is not sold to any third party for marketing purposes without explicit consent.
• Limited data may be shared with technical service providers (hosting, analytics) under confidentiality and data-protection agreements.
• Data may be disclosed to judicial, security, or regulatory authorities in the UAE upon an official request or legal obligation.

4. Transfer of Data Outside the State

Where data is stored or processed on servers located outside the State, this is carried out in compliance with the controls set out in the Personal Data Protection Law, ensuring an equivalent level of protection.

5. User Rights

In accordance with the Federal Personal Data Protection Law, the user has the right to:

• Access their personal data held by the Application.
• Request correction of inaccurate data.
• Request deletion of their data (the "right to be forgotten") within legal limits.
• Withdraw their consent to the processing of their data at any time.
• Object to the use of their data for marketing purposes.
• Lodge a complaint with the Data Office in the State.

6. Data Security

Appropriate technical and organizational measures (encryption, access control, security monitoring) are implemented to protect data against unauthorized access, loss, or unlawful disclosure.

7. Data Retention Period

Data is retained for the duration the account is active, and is deleted or anonymized within a specified period after account closure, unless the law requires a longer retention period.

8. Privacy of Minors

The Application is not intended for children under the legal age of eligibility, and their data is not knowingly collected. If it is established that a minor's data has been collected without guardian consent, the account will be deleted immediately.

9. Cookies and Tracking Technologies

The Application or its website may use cookies to improve performance, and the user may manage their preferences through their device or browser settings.

"Jari" is a technical platform that solely facilitates communication among neighbors and is not a party to any agreement, transaction, or service carried out between users. The Application bears no responsibility for the quality of services exchanged, the accuracy of advertisements, or the conduct of users outside the scope of the Application.

2. No Guarantee of Content Accuracy

Content posted by users reflects their personal opinions only and does not necessarily reflect the views of the Application's administration. The Application does not guarantee the accuracy, correctness, or completeness of any information posted by users.

3. Disclaimer Regarding Identity Verification

Despite taking measures to verify users' identities and residential addresses, the Application does not absolutely guarantee the accuracy of every user's data, and it remains the user's responsibility to exercise caution when interacting with others, particularly during in-person meetings.

4. Limitation of Legal Liability

To the fullest extent permitted by UAE law, the Application, its owners, and its operators shall bear no liability for any direct, indirect, incidental, or consequential damages arising from the use of the Application or interactions between users, including material or moral damages or loss of data.

5. Availability of the Service

The Application does not guarantee uninterrupted or error-free service continuity, and reserves the right to modify or suspend the Service, in whole or in part, for maintenance, development, or regulatory reasons.

6. Reporting Violations

The Application provides a mechanism for reporting any content or conduct that violates these Terms or applicable laws in the State, and the Application's administration is committed to handling reports seriously and taking appropriate action, including full cooperation with official authorities upon request.
